Terms of Service

1. Acceptance of Terms

By accessing kuraga.com, requesting a free audit, or subscribing to any Kuraga plan, you confirm that:

• You are at least 18 years of age
• You are authorised to enter into this agreement on behalf of your business
• You have read and understood these Terms

These Terms form a legally binding agreement between you ("Client") and Kuraga ("we", "us", "our"), a business registered in Malta.

2. Our Services

Kuraga provides Local SEO services for small and medium-sized businesses in Malta. Services vary by plan and may include:

• Google Business Profile (GBP) optimisation and management
• Local citation building and directory submissions
• On-page SEO optimisation
• Review management and strategy
• Monthly performance reports
• Keyword tracking and ranking monitoring
• Website SEO audit and recommendations

The specific deliverables for each plan are as described on our website at the time of subscription. We reserve the right to adjust service components with reasonable notice.

3. Subscriptions & Billing

Plans & Pricing

Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payments are processed securely by Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring basis
• All prices are in EUR (Euro) and are inclusive of any applicable VAT where required
• Your subscription renews automatically unless cancelled before the renewal date

Failed Payments

If a payment fails, we will notify you by email. We will attempt to retry the charge. If payment remains outstanding after 7 days, your subscription may be suspended until payment is received.

4. Cancellation & Refunds

Cancellation

• You may cancel your subscription at any time via your Stripe billing portal or by emailing team@kuragalocal.com
• Cancellation takes effect at the end of your current billing period. You retain access to services until that date
• We do not charge cancellation fees

Refunds

• Within 7 days of first subscription: If you are genuinely unsatisfied and no substantial work has commenced, contact us and we will review refund requests on a case-by-case basis
• After 7 days: No refunds are issued for the current billing period
• Annual subscriptions: if cancelled within 14 days of annual renewal, a pro-rata refund for unused months may be issued at our discretion

To request a refund, email team@kuragalocal.com with your account details and reason for the request.

5. Your Obligations

To allow us to deliver our services effectively, you agree to:

• Provide accurate and complete information about your business
• Grant us access to your Google Business Profile, Google Search Console, and/or website where required
• Respond to our communications in a reasonable timeframe
• Not engage any other SEO provider for the same services simultaneously without notifying us (as conflicting work can harm your rankings)
• Not engage in black-hat SEO practices or ask us to do so

Delays caused by your failure to provide required access or information may affect delivery timelines and are not the responsibility of Kuraga.

6. SEO Results & Expectations

Search engine rankings are determined by Google's algorithms, which are outside our control. Factors affecting SEO performance include but are not limited to: domain age, existing competition, website quality, Google algorithm updates, and seasonal trends.

We commit to:

• Applying industry best practices and proven local SEO strategies
• Providing honest, transparent monthly reporting
• Working consistently toward improving your local visibility

We do not guarantee first-page rankings, a specific number of leads, or any particular business outcome.

7. Intellectual Property

All content on kuraga.com — including text, graphics, logos, and code — is the property of Kuraga and protected by applicable intellectual property laws.

Work product created specifically for your business (e.g. optimised GBP descriptions, written content) is owned by you upon full payment. Strategies, templates, and reporting formats remain the intellectual property of Kuraga.

8. Limitation of Liability

To the fullest extent permitted by Maltese law:

• Kuraga's total liability to you for any claim arising from these Terms shall not exceed the total amount paid by you in the 3 months preceding the claim
• We are not liable for indirect, incidental, or consequential damages including loss of profit, loss of data, or business interruption
• We are not responsible for losses caused by Google algorithm changes, third-party platform outages, or actions taken outside of our service scope

Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence.

9. Termination

We reserve the right to terminate or suspend your subscription immediately if:

• You breach any material provision of these Terms
• Payment cannot be collected after repeated attempts
• You engage in abusive, threatening, or unlawful behaviour toward our team
• You ask us to perform activities that violate Google's guidelines or applicable law

In such cases, no refund will be issued for the current billing period. You may cancel your subscription at any time as described in Section 4.

10. Governing Law

These Terms are governed by the laws of Malta and the European Union. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Maltese courts.

If you are a consumer in the EU, you may also have the right to refer a dispute to the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify active subscribers by email at least 14 days in advance. The updated Terms will also be posted on this page with a new "Last updated" date.

Continued use of our services after the effective date of changes constitutes your acceptance of the updated Terms.
